ICO Guidance

ICO has published a blog on Subject Access Requests with common themes and key takeaways from its past work, designed to help firms handle this type of request.

ICO has also published guidance for firms carrying out direct marketing using live calls. The guidance explains how the Privacy and Electronic Communications Regulations (PECR) applies to making live direct marketing calls (marketing calls where a live a live person is speaking to the person they are calling). If a prospective or existing customer asks a mortgage intermediary firm to call them (for example in response to an advert) a firm can call the person and most of the PECR rules don’t apply.

This guidance is concerned with unsolicited direct marketing calls. It is not relevant for live calls that are made for administrative or customer service purposes.
